SwellPro Terms of Use

Use of the SwellPro app and related services is subject to these Terms. If you do not agree, do not use the service.

1. General information only — not permission to enter the water

Safety warning: A forecast, beach rating, or AI answer — including a description of the sea as calm or conditions as good — does not mean the water is safe and is not a recommendation or clearance to enter it. Do not rely on SwellPro as a real-time safety, warning, rescue, or supervision system.

The app may display marine and weather forecasts, beach information, cameras or third-party links, and AI-generated comparisons and answers. Information may be incomplete, inaccurate, delayed, or unrelated to the exact place where you are. Conditions may change rapidly without an immediate update in the app.

2. Swimming, surfing, and other marine activities

Rip currents, unexpected waves, changing depth, rocks, wind, storms, pollution, watercraft, and other hazards may exist even when the sea looks calm or the forecast shows small waves. The app may not include currents, warning flags, lifeguard status, water quality, or every local hazard.

Before any activity, check official alerts and on-site conditions; follow lifeguards, authorities, signs, and flags; and consider your ability, suitable equipment, and supervision. If a warning is in effect, appropriate supervision is unavailable, or safety is uncertain, do not use the app to justify entering the water. Children require appropriate supervision. In an emergency, contact local emergency services immediately; the app is not an emergency service.

3. Automated content and external sources

AI answers can be wrong, invent details, or miss important hazards. A beach ranking or comparison is relative only and does not establish that any beach is safe. Verify important information with official sources and qualified people at the location. Third-party links, videos, cameras, and data may be subject to their own terms; we do not fully control their availability or accuracy.

4. Accounts and fair use

Provide accurate account information and protect access to your account. Do not use the service unlawfully, interfere with it, circumvent usage limits, or present its answers as official safety clearance. The service is intended for ordinary personal use, subject to applicable law.

5. Subscriptions, renewal, and cancellation

Some features may require an auto-renewing subscription. The applicable subscription period, total billing price, and renewal terms are shown in the relevant store before purchase confirmation. Billing, renewal, cancellation, and refunds are governed by Apple or the store used for the purchase. Deleting the app or account does not cancel a subscription. Apple purchases can be managed through Apple subscriptions.

6. Availability, liability, and changes

We do not guarantee that the service or any information in it will be available, uninterrupted, current, accurate, or error-free. To the fullest extent permitted by law, we are not liable for harm caused by treating app content as safety clearance, ignoring official instructions, or hazards the app cannot predict. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights. We may update the service and these Terms, subject to applicable law; the update date will appear above.
